This Privacy Policy explains how DZX Logistics LLC, doing business as ATREK (“ATREK,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information through our websites, web platform, mobile applications, documentation, and related services.
For account, website, billing, product analytics, security, and direct business-contact information, ATREK generally determines why and how information is processed.
For personal information uploaded, connected, or collected by a customer through the Services—such as driver, employee, contractor, broker, load, document, email, and location information—ATREK generally acts on that customer’s instructions. The customer determines the purpose and lawfulness of that processing and is responsible for its own privacy notices, legal basis, permissions, and responses to individuals. ATREK is entitled to rely on the customer’s representations and instructions unless ATREK knows an instruction is unlawful.
Requests about customer-controlled data should first be directed to that customer. This Policy does not create rights beyond those provided by applicable law or contract.
Depending on use and configuration, we may process:
We receive information directly from users and customers; from mobile devices and browsers; from connected email, loadboard, messaging, maps, payment, and communications services; from brokers and other business counterparties; and from service providers that help operate the Services.
We use information to:
When enabled by a customer and user, the ATREK Driver App may collect precise location in the foreground and background to provide load and vehicle tracking, route progress, location history, and broker-facing tracking. Device permissions, network conditions, battery settings, and third-party maps may affect accuracy and frequency.
Customers are solely responsible for determining whether tracking is lawful, providing all required notices, obtaining and recording permissions, configuring access, and responding to tracked persons. Disabling device permissions may reduce or disable tracking features.
By using the ATREK Driver App, you agree to the collection and use of information from and through that mobile application in accordance with this Privacy Policy. This statement applies specifically to the ATREK Driver App and does not replace any separate consent, acknowledgement, notice, or authorization required for the web platform, company-level agreements, connected services, billing actions, or location permissions.
If a user connects Google Workspace or Gmail, ATREK accesses only the permissions authorized by the user to provide requested functions, which may include reading relevant messages, parsing load or broker information, sending messages, and changing read status.
ATREK’s use and transfer of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.
We do not use Google Workspace API data to serve advertisements, build advertising profiles, or for purposes unrelated to providing or improving user-facing features, security, or legal compliance. Users may revoke access through their Google account or disconnect the integration in ATREK.
Other email providers and integrations are governed by their own privacy terms.
We may disclose information:
We do not sell personal information for money. We do not share mobile phone opt-in or consent information with third parties for their own marketing.
We use cookies and similar technologies that are necessary for login, security, preferences, performance, and, where enabled, analytics. Details and available choices are described in the Cookie Notice. We honor legally required browser-based opt-out signals where applicable.
We retain information for as long as we reasonably determine necessary to provide and secure the Services, administer contracts and billing, prevent fraud, resolve disputes, enforce rights, and satisfy legal, tax, accounting, insurance, and recordkeeping duties.
After paid access ends, the Company Administrator ordinarily receives 30 days of limited access, after which Customer Data is deleted from active systems. Backup copies expire through standard rotation and are not available for ordinary restoration. Certain records may be retained longer where legally permitted or required. Customers are responsible for preserving information they need before access ends. See the Data Retention & Deletion Policy.
We use administrative, technical, and organizational safeguards designed for the nature of the information. Safeguards and providers may change as the Services and threats evolve. No transmission, storage, device, account, or system is completely secure, and ATREK does not guarantee absolute security or that unauthorized access will never occur.
Customers are responsible for user permissions, credentials, endpoints, integrations, lawful collection, internal policies, and promptly reporting suspected misuse.
The Services process information relating to drivers and other individuals who reside in California. Depending on the role of ATREK, the role and status of the applicable Customer, and applicable law, California and other U.S. residents may have rights to know or access personal information, correct it, delete it, receive a portable copy, opt out of certain sale, sharing, targeted advertising, or profiling, limit certain use or disclosure of sensitive personal information, appeal a decision, and receive equal treatment.
California sensitive personal information processed through the Services may include driver’s-license information, precise geolocation, medical-card or health-related information, financial-account or direct-deposit information, work-eligibility or immigration-related information, and the contents of email or text messages. ATREK does not use Customer-controlled sensitive personal information for targeted advertising or sell it for money. Disclosures to subprocessors and Customer-directed integrations are made to provide, secure, support, analyze, or improve the Services or carry out Customer instructions, subject to applicable agreements and law.
For information controlled by a carrier or other ATREK Customer, the individual should ordinarily submit the request to that Customer. The Customer determines the purpose and lawfulness of the processing, provides any required notice at collection, and is responsible for responding to the individual. ATREK may direct the request to the Customer or assist only as required by the DPA or applicable law.
For information controlled directly by ATREK, submit a request to info@atrek.icu. We may require information necessary to verify identity, California residency or other jurisdiction, authority, scope, and authenticity. We may deny, limit, or charge for a request where applicable law permits, including when identity cannot be verified, an exemption applies, the request is excessive or manifestly unfounded, or retention is legally permitted. Authorized agents must provide proof of authority where permitted by law.
Users may unsubscribe from marketing emails using the link provided. Account, security, billing, and service messages are transactional and may still be sent. SMS choices are described in the SMS Messaging Terms.
The Services are not directed to children under 18, and we do not knowingly collect their information. Contact us if you believe a child has provided information.
ATREK is based in the United States, and ATREK’s production servers are located in the United States. ATREK limits access to personal information to authorized personnel who need it to provide, support, secure, or operate the Services and who are subject to confidentiality obligations. Third-party providers may process information in the United States or other locations under their own infrastructure and terms. Where applicable law requires a transfer mechanism, the applicable contractual or other lawful safeguard is used.
We may update this Policy to reflect legal, security, operational, provider, or product changes. The version posted with a new “Last Updated” date replaces prior versions prospectively.
For material changes affecting the categories of information collected, purposes of processing, disclosures, individual rights, or use of sensitive information, ATREK may provide additional notice and request acknowledgement of the updated Policy. Consent will be requested where applicable law requires consent. An acknowledgement of this Policy is not consent to processing for which a separate legal basis, device permission, or authorization is required.
